Final Rule on Career Tenure

OPM has issued a final rule on creditable service for career tenure (81 FR 78497).  The final rule changes the regulation in section 315.201 of title 5, Code of Federal Regulations (CFR) on service requirement for career tenure by removing “substantially continuous service” as well as the basis for the 30 day break-in-service rule from the requirement for career tenure.  Each period of creditable service will now stand alone, and breaks in service will be irrelevant.  Under this final rule, an employee may attain career tenure after completing at least 3 years of total creditable service as described in 5 CFR 315.201(b).

While the issuance of an OPM CHCO memorandum and other pertinent guidance is anticipated, agencies have the authority to implement this revised regulation as of December 8, 2016.
